Orestack Terms of Service

IMPORTANT RISK WARNING: Cryptocurrency, blockchain applications and decentralised finance activities involve substantial risks. Mining ORE may result in the partial or complete loss of the SOL or other assets you deploy. Only use funds you can afford to lose. Please read these Terms carefully before using Orestack.

1. Acceptance of Terms

By accessing or using Orestack, including its website, applications, interfaces and related services collectively referred to as the “Service”, you agree to be bound by these Terms of Service.

If you do not agree to these Terms, you must not access or use the Service.

2. Description of the Service

Orestack is a self-custodial application that provides tools for interacting with the ORE mining protocol on the Solana blockchain.

The Service may allow users to:

Orestack uses or provides an interface to the Evore smart contract developed by Kriptikz. Evore is separate from Orestack. Orestack does not own or control the Evore smart contract unless expressly stated otherwise.

Orestack may also interact with the ORE protocol and other third-party blockchain infrastructure. These protocols and services operate independently from Orestack.

3. Self-Custody and Blockchain Transactions

Orestack is a self-custodial application.

Orestack does not take custody of your wallet, private keys or digital assets. You connect your own compatible Solana wallet and authorise the transactions or on-chain permissions required to use the Service.

Transactions submitted through Orestack may be executed by smart contracts according to the settings, permissions and parameters you approve. Once a blockchain transaction has been submitted or confirmed, it may be irreversible.

You are solely responsible for:

Orestack cannot recover lost private keys, reverse confirmed transactions or restore access to a wallet.

4. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use the Service.

By using Orestack, you represent and warrant that:

5. User Responsibilities

You are responsible for all activity performed through your wallet or device.

Orestack is not responsible for losses arising from compromised wallets, exposed seed phrases, malicious browser extensions, phishing attacks, user error or unauthorised access to your device.

6. Automated Mining and Smart-Contract Permissions

Certain Orestack features may allow mining transactions to be executed automatically through supported smart contracts, including Evore, according to parameters selected and authorised by you.

By enabling an automated feature, you acknowledge and agree that:

Disabling a feature through the Orestack interface may require an on-chain transaction. A requested change may not take effect until that transaction has been confirmed.

7. Financial and Technical Risks

7.1 General Risk Warning

Cryptocurrency and DeFi activities are speculative and involve a substantial risk of loss.

You should not use Orestack unless you understand these risks and can afford to lose the SOL and other assets you put at risk through the Service. A missed square does not forfeit 100% of the stake: after ORE protocol fees a miss typically returns about 89.1% of that square’s deploy, and a hit returns about 99% of that square’s own stake (not a share of other miners’ SOL). You can still lose substantially from protocol fees, Orestack fees, ORE price moves, variance, and smart-contract or operational failure, including in some cases a complete loss.

8. Data, Estimates and Expected-Value Calculations

Orestack may display estimated returns, expected value, break-even prices, profitability measurements, historical performance and other calculations.

Displayed data may be inaccurate, delayed or incomplete. You should independently verify information before making a transaction.

No calculation, label, strategy name, ranking or recommendation displayed by Orestack constitutes a promise of performance.

9. Fees

Orestack may charge fees for mining transactions or other features. Applicable fees will be displayed in the Service or documented in Orestack’s published materials.

You are responsible for reviewing the applicable fees before authorising a transaction.

Orestack may change its fees in the future. Any updated fees will apply to transactions made after the change becomes effective.

10. Third-Party Protocols and Services

Orestack may provide access to, integrate with or display information obtained from third-party services, including:

Orestack does not control these third parties and is not responsible for their operation, security, availability, accuracy or conduct.

The inclusion of a third-party integration does not constitute an endorsement or guarantee.

Your use of a third-party service may also be subject to that party’s own terms and policies.

11. No Financial, Legal or Tax Advice

Orestack provides software tools and information. It does not provide financial, investment, trading, legal, accounting or tax advice.

Nothing displayed through the Service, including expected-value calculations, strategy presets, historical statistics or mining suggestions, should be treated as a recommendation to acquire, sell, hold or deploy any asset.

You should conduct your own research and consult qualified professional advisers before making financial, legal or tax decisions.

12. No Guarantees

Orestack does not guarantee:

You use the Service entirely at your own risk.

13. Prohibited Activities

14. Intellectual Property

The Orestack name, branding, interface, content and proprietary software are owned by Orestack or its licensors, except where otherwise stated.

Third-party software and smart contracts, including Evore, remain the property of their respective developers or rights holders and may be subject to separate licences.

These Terms do not grant you ownership of Orestack or any third-party intellectual property.

15. Service Availability and Modifications

Orestack may modify, update, suspend, restrict or discontinue any part of the Service at any time.

This may include:

Orestack is not liable for losses resulting from a modification, suspension or discontinuation of the Service.

Where reasonably practicable, Orestack may provide notice of significant changes, but it is not required to do so unless applicable law requires otherwise.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ORESTACK, ITS OPERATORS, CONTRIBUTORS, CONTRACTORS AND AFFILIATES SHALL NOT BE LIABLE FOR:

Where liability cannot legally be excluded, Orestack’s aggregate liability shall be limited to the greater of:

  1. The fees paid directly to Orestack by you during the three months preceding the event giving rise to the claim; or
  2. £100.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud or fraudulent misrepresentation.

17. Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold harmless Orestack, its operators, contributors, contractors and affiliates from claims, liabilities, losses, damages and expenses arising from:

You are solely responsible for determining and satisfying any taxes, reporting obligations or other governmental charges arising from your use of Orestack or receipt of ORE.

Orestack does not calculate, collect or submit taxes on your behalf unless expressly stated otherwise.

19. Termination

You may stop using Orestack at any time.

You remain responsible for disabling active strategies and revoking any on-chain permissions that you no longer wish to maintain.

Orestack may restrict or terminate your access to its hosted interface where it reasonably believes that you have:

Termination of access to the Orestack interface does not necessarily stop activity authorised through an independent on-chain smart contract. You are responsible for revoking or changing those permissions directly.

20. Governing Law

These Terms and any dispute or claim arising from them shall be governed by the laws of United Kingdom, without regard to conflict-of-law principles.

21. Dispute Resolution

Before beginning formal legal proceedings, you agree to contact Orestack and attempt to resolve the dispute through good-faith negotiation.

Any dispute that cannot be resolved through negotiation shall be handled by the courts or dispute-resolution process specified under the laws of United Kingdom.

Nothing in this section prevents either party from seeking urgent injunctive relief where reasonably necessary.

22. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by law. The remaining provisions will continue in full force and effect.

23. No Waiver

A failure by Orestack to enforce any provision of these Terms does not waive its right to enforce that provision later.

24. Changes to These Terms

Orestack may update these Terms from time to time.

The updated version will be made available through the Service and will include a revised “Last Updated” date.

Your continued use of Orestack after updated Terms become effective constitutes your acceptance of those Terms.
